Victory over aerobridge patent infringement at the Supreme People’s Court


The result of verdict strengthens our confidence in the fairness of China’s intellectual property protection.

This October, thyssenkrupp Airport Systems Zhongshan won the six-year long aerobridge patent infringement case at the Supreme People’s Court of the People’s Republic of China.

In 2011, China International Maritime Containers (Group) Limited (CIMC) and Shenzhen CIMC-TianDa Airport Support Company brought up an indictment on the infringement of the patent of the aerobridge by thyssenkrupp Airport Systems Zhongshan. The case had successively stood the first and second instances of Guangzhou Intermediate People’s Court and Guangdong Higher People’s Court, and was finally submitted to the Supreme People’s Court in April this year.

thyssenkrupp maintained that the aerobridge involved in this case was an available technology, and submitted detailed evidence to the court despite of difficulties in taking of evidence abroad. The Supreme People’s Court finally recognized our claims and affirmed that thyssenkrupp had not violated the patent. The first-instance and second-instance verdicts previously made by Guangzhou Intermediate People’s Court and Guangdong Higher People’s Court were abrogated.

thyssenkrupp has protected its legitimate rights with determination and persistence, and proved its technical privilege. China is one of the most important strategic markets of the Group, and also a country that focuses on the protection of intellectual property. In the future, thyssenkrupp’s intellectual property department will enhance its layout in China.
